Terms of Service

Introduction

Welcome to 3GMRC. These Terms of Service ("Terms") govern your access to and use of the 3gmrc.com.au website, our mobile applications, and the eSIM and connectivity products and services we provide (together, the "Service"). By using the Service, you confirm that you are able and legally competent to agree to and comply with these Terms.

You must be at least 18 years old to create an account or purchase from us. If you are a parent or guardian permitting a minor to use the Service, you agree to be bound by these Terms in respect of that use.

Privacy & Security

Our Privacy Policy is incorporated into these Terms by reference. We maintain appropriate physical, electronic, and managerial safeguards to protect your information, while reserving the right to disclose information where required for legal compliance.

Changes to These Terms

We may modify these Terms, our Privacy Policy, and the Service from time to time. Changes take effect when you next access the Service. We will update the "Last Updated" date at the top of this page; significant changes will be communicated through the Service or by email where appropriate. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@3gmrc.com.au if you suspect unauthorised use of your account. We may suspend or terminate accounts that we reasonably believe have been compromised or misused.

eSIM Purchases & Activation

User-Generated Content

You retain ownership of content you submit to the Service (such as reviews, ratings, support messages, or forum posts). By submitting such content, you grant 3GMRC a perpetual, worldwide, non-exclusive, irrevocable, royalty-free licence to use, reproduce, modify, and distribute that content in connection with operating and promoting the Service.

We do not endorse or assume responsibility for user-submitted content and reserve the right to refuse, remove, edit, or delete any user content, or to terminate accounts, where we reasonably believe content breaches these Terms or applicable law.

The Service may contain links to third-party websites or services that are not owned or controlled by 3GMRC. We are not responsible for the content, privacy practices, or reliability of such third parties. Accessing those sites is at your own risk.

Communications

Communications and feedback you send to us (such as suggestions, ideas, or product feedback) are not considered confidential, and we may use them freely for any purpose, including product development, without obligation or compensation to you.

Limitation of Liability

To the maximum extent permitted by Australian law, 3GMRC and its directors, employees, and affiliates are not liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of (or inability to use) the Service, including damages for loss of data, profits, or business interruption. Where liability cannot be excluded by law, our maximum aggregate liability to you is limited to the greater of (i) the amount you paid to us for the affected purchase in the twelve months preceding the claim, or (ii) AUD $100.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other law that cannot be lawfully excluded.

Termination

We may suspend or terminate your account, with or without prior notice, where we reasonably believe you have breached these Terms or used the Service unlawfully. The following sections survive termination: intellectual-property rights, user-generated content licences, acceptable use, limitation of liability, and dispute resolution.

System Outages & Maintenance

The Service may from time to time be unavailable due to scheduled maintenance, technical issues, or events beyond our reasonable control. We are not liable for losses arising from such outages or for any data loss resulting from downtime, except as required by law.

Governing Law

These Terms are governed by the laws of Australia. Any dispute arising out of or relating to the Service or these Terms will be subject to the non-exclusive jurisdiction of the courts of Australia.
